General Terms and Conditions

1. Scope
1.1 These terms apply to all orders you place via our online shop petamor.de and the associated country domains with Petamor, Schweighofplatz 23, 6010 Kriens, Switzerland ("we").
1.2 Deviating terms of the customer do not apply unless we expressly agree to them.

2. Conclusion of the contract
2.1 The presentation of products in the shop is not a binding offer but an invitation to place an order.
2.2 By clicking the button to complete your order, you submit a binding offer. Until then, you can check and correct your entries at any time.
2.3 You will then receive an automatic confirmation of receipt by email. This does not yet constitute acceptance. The contract is concluded when we confirm your order by email or ship the goods. When paying with PayPal, credit card, Apple Pay or Shop Pay, the contract is concluded as soon as the payment process is completed.
2.4 We store the contract text and send you the order details by email. If you have a customer account, you can also find your orders there.
2.5 The contract language is German. Translations are provided for information purposes.

3. Personalized products and your content
3.1 Our products are made individually according to your specifications (photos, names, texts). Please check your details carefully before ordering. Changes are no longer possible once production has started.
3.2 You confirm that you hold the rights to the content you upload and that it does not infringe any third-party rights, in particular copyrights, trademark rights and personality rights. You indemnify us against third-party claims asserted against us due to an infringement for which you are responsible.
3.3 We may refuse orders whose content is unlawful, offensive, discriminatory, glorifies violence or is harmful to minors. In this case, we will refund any amounts already paid.
3.4 Minor deviations in colour, print and placement compared to the on-screen display may occur due to production and do not constitute a defect.

4. Right of withdrawal
Details can be found in our cancellation policy. There is no right of withdrawal for personalized products (Section 312g (2) no. 1 German Civil Code, BGB).

5. Prices and shipping costs
5.1 All prices are final prices and include statutory VAT where applicable.
5.2 We charge a flat shipping rate of €4.95 per order, regardless of the delivery country.
5.3 For deliveries to countries outside the EU (e.g. Switzerland, the United Kingdom, the USA, Canada, Australia), customs duties, import taxes or fees may apply, which you bear unless otherwise stated at checkout.

6. Payment
6.1 The payment methods shown at checkout are available to you, including credit card, PayPal, Apple Pay, Shop Pay, Bancontact and prepayment by bank transfer.
6.2 For prepayment, production starts once payment has been received.

7. Delivery
7.1 We deliver to Germany, Austria, Switzerland, the USA, the United Kingdom, France, Italy, Spain, Canada, Australia, the Netherlands and Belgium.
7.2 Delivery times can be found in our shipping policy and on the respective product page.
7.3 For consumers, the risk only passes to you upon handover of the goods.

8. Retention of title
The goods remain our property until paid for in full.

9. Warranty
9.1 The statutory warranty rights apply.
9.2 If your goods are damaged or defective, please contact us within 14 days of receipt at support@petamor.de, stating your order number and including a photo. We will then arrange a free replacement or a refund. Your statutory rights remain unaffected.
9.3 Please also report obvious transport damage to the carrier where possible. If you do not, this has no effect on your statutory rights.

10. Liability
10.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory statutory provisions such as product liability law.
10.2 In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.

11. Vouchers
11.1 Vouchers can only be redeemed in our online shop and only before the order is completed. One voucher can be redeemed per order.
11.2 Vouchers cannot be exchanged for cash. Promotional vouchers are only valid for the stated period.
11.3 Purchased gift vouchers can be redeemed until the end of the third year after the year of purchase.

12. Applicable law and place of jurisdiction
12.1 Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law only applies insofar as it does not deprive you of the protection of mandatory provisions of the country in which you have your habitual residence.
12.2 The place of jurisdiction for merchants and businesses is Kriens, Switzerland. For consumers, the statutory places of jurisdiction apply.

13. Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. If you have a problem, simply write to us at support@petamor.de and we will find a solution.
